AI Regulation in Asia-Pacific — South Korea, Japan, Singapore, Australia (2026)


The Asia-Pacific region doesn’t have a single AI regulation story — it has five. South Korea passed the world’s second comprehensive AI law. Japan is betting that voluntary guidelines and industry self-regulation will be enough. Singapore built a testing toolkit. Australia is still drafting. India is watching.

If you’re building AI products for APAC markets, you can’t treat the region as a monolith. Each country has landed on a fundamentally different philosophy, and the compliance requirements range from “legally binding with penalties” to “please consider these principles.”

South Korea — the strict one

South Korea’s AI Basic Act took effect on January 22, 2026, making it the world’s second comprehensive AI law after the EU AI Act. The two share DNA — both use risk-based frameworks — but the Korean law has its own teeth.

What it covers:

  • Risk-based classification. AI systems are categorized by risk level. High-risk systems (healthcare, hiring, criminal justice, critical infrastructure) face the strictest requirements.
  • Transparency requirements. Users must be informed when they’re interacting with AI. AI-generated content needs disclosure. High-risk systems require explainability documentation.
  • Extraterritorial application. If your AI system affects people in South Korea, the law applies to you — regardless of where your company is based. Sound familiar? It’s the same approach as the EU AI Act and GDPR.
  • Government oversight body. A dedicated authority has enforcement powers, including the ability to audit AI systems and demand documentation.
  • Penalties. Violations carry fines and potential operational restrictions. The penalty structure targets both companies and responsible individuals.

Developer takeaway: If you serve Korean users, you need risk assessments, transparency mechanisms, and documentation — now. This isn’t a future deadline. The law is live.

Japan — the voluntary one

Japan has taken the opposite approach. There is no binding AI law, and the government has signaled it doesn’t plan to create one in the near term.

Instead, Japan relies on:

  • AI Guidelines for Business (originally published 2024, regularly updated) — a set of practical recommendations for companies developing or deploying AI.
  • Social Principles of Human-Centric AI — high-level principles emphasizing human dignity, diversity, sustainability, and education.
  • Industry self-regulation — sector-specific bodies are expected to develop their own standards within the government’s framework.

The philosophy is deliberate. Japan’s position is that overly prescriptive regulation risks stifling innovation, particularly in a country that sees AI as central to addressing its demographic and economic challenges.

Developer takeaway: No legal compliance burden specific to AI — but that doesn’t mean “anything goes.” Japanese business culture takes guidelines seriously, and major enterprise clients will expect alignment with the published principles. Singapore — the testing one

Singapore’s approach is the most technically interesting for developers. Rather than writing rules, Singapore built a tool.

AI Verify is an open-source testing framework and toolkit that lets companies validate their AI systems against governance principles. It provides standardized tests for fairness, explainability, robustness, and transparency — and generates reports that companies can share with stakeholders.

Alongside AI Verify, the Model AI Governance Framework (first published 2019, updated since) provides principles-based guidance on responsible AI deployment. It’s voluntary and non-prescriptive, but it’s become a de facto standard in Singapore’s business environment.

  • Singapore is actively working on ASEAN-wide AI governance alignment, positioning itself as the regional standard-setter.
  • The government is moving toward more structured governance — not binding law yet, but the direction of travel is toward firmer expectations.
  • AI Verify is gaining traction beyond Singapore, with international organizations referencing it as a model for AI testing.

Developer takeaway: If you’re deploying AI in Singapore, run your system through AI Verify. It’s free, it’s open-source, and having a passing report is increasingly expected by enterprise clients and government agencies. It’s also good practice regardless of jurisdiction.

Australia — the drafting one

Australia doesn’t have a comprehensive AI law, but it’s actively working toward one.

The current state:

  • Voluntary AI Ethics Principles (2019) provide eight principles: human, societal and environmental wellbeing; human-centred values; fairness; privacy protection and security; reliability and safety; transparency and explainability; contestability; and accountability.
  • The government is running an active consultation process on mandatory guardrails for high-risk AI systems.
  • Draft proposals suggest Australia will follow the risk-based model (similar to the EU and South Korea) but with a lighter touch.

The timeline is uncertain. Australia tends to move deliberately on technology regulation, and there’s significant industry lobbying on both sides. But the direction is clear: some form of mandatory requirements for high-risk AI is coming.

Developer takeaway: No binding requirements today, but if you’re building for the Australian market, design with the voluntary principles in mind. When mandatory rules arrive, systems built on those principles will have a much easier compliance path.

India — the watching one

India has no comprehensive AI legislation and isn’t close to passing one. The regulatory landscape is fragmented:

  • IT Act amendments cover some AI-adjacent issues (deepfakes, misinformation) but don’t constitute an AI framework.
  • NITI Aayog’s Responsible AI principles provide guidance but carry no legal weight.
  • The government’s stated priority is innovation over regulation — India wants to be an AI development hub and views heavy regulation as a competitive disadvantage.

Developer takeaway: Minimal AI-specific compliance requirements for now. Standard data protection rules (Digital Personal Data Protection Act) still apply. Keep an eye on sector-specific rules that may emerge in finance and healthcare.

What this means for developers building for APAC

Five countries, five philosophies. Here’s how to think about it practically:

1. South Korea requires action now. If your AI system touches Korean users, you need risk classification, transparency disclosures, and documentation. Treat it with the same seriousness as the EU AI Act’s August 2026 deadline.

2. Build to the highest standard. If you’re shipping across multiple APAC markets, build to South Korea’s requirements. You’ll automatically satisfy the voluntary frameworks in Japan, Singapore, and Australia — and you’ll be ready when those countries tighten their rules.

3. Use Singapore’s AI Verify as your testing baseline. Even if you’re not deploying in Singapore, the toolkit provides a structured way to validate fairness, explainability, and robustness. It’s free and it’s good.

4. Watch Australia closely. Mandatory guardrails are coming. The consultation process is your chance to influence the outcome — and to prepare early.

5. Don’t ignore voluntary frameworks. In Japan and Singapore, “voluntary” doesn’t mean “optional” in practice. Enterprise clients, government contracts, and industry partnerships increasingly expect alignment with published guidelines.

The APAC regulatory landscape is diverging now, but it’s likely to converge over time — probably toward something resembling the risk-based model that South Korea and the EU have adopted. Building for that future today saves you from scrambling later.
